These Terms of Service ("Terms") govern your access to and use of the SoberBeing iOS application ("App") and the soberbeing.com website ("Website"), provided by Sven Plochberger, Austria ("we", "us", "I"). By installing, opening, or using the App or by browsing the Website, you agree to these Terms.
If you don't agree to these Terms, please don't use the App or the Website.
1. The service
SoberBeing is a personal, private sobriety-tracking application for iOS. It helps you log sober days, journal your thoughts, view your progress on a calendar, and care for a "buddy" companion that responds to how you engage with the App.
SoberBeing is a self-tracking tool. It is not medical advice, medical treatment, addiction counseling, therapy, a substitute for professional care, or a medical device under EU Regulation 2017/745 (MDR). See our Medical Disclaimer for the long version.
2. Eligibility
You must be at least 17 years old to use the App. By using the App you confirm that you are 17 or older. If you are not, please uninstall the App.
3. Your account
The App has no account, no login, and no cloud sync. All your data lives on your iPhone. We cannot retrieve, restore, or transfer it. Deleting the App or tapping "Reset and start over" inside the App deletes your data permanently.
4. Subscriptions, free trials, billing, and cancellation
4.1 Subscription tiers
SoberBeing offers two auto-renewable subscription options that unlock full access to the App:
- Weekly: €2.99 per week, with a 7-day free trial.
- Yearly: €39.99 per year, with a 7-day free trial.
Prices may vary by territory based on App Store pricing tiers and local taxes. The price displayed in the App at the time of purchase is the binding price.
4.2 Apple is the merchant of record
All purchases are processed by Apple Inc. through the App Store and your Apple ID. Apple, not us, is the merchant of record for all subscription transactions. By subscribing, you also accept Apple's Media Services Terms.
4.3 Free trial and auto-renewal
When you start a free trial:
- Apple immediately reserves the first billing amount on your Apple ID payment method, but does not charge it for 7 days.
- The trial automatically converts to a paid subscription at the price shown above unless you cancel at least 24 hours before the trial ends.
- Subscriptions renew automatically at the end of each billing period (1 week or 1 year) at the same price unless you cancel at least 24 hours before the end of the current period.
4.4 Managing and cancelling
You can manage or cancel your subscription at any time in your iPhone's Settings → [your name] → Subscriptions. Cancellation takes effect at the end of the current billing period; you keep access until then. Deleting the App does not cancel your subscription.
4.5 Refunds
All refund requests must be made directly to Apple via reportaproblem.apple.com. We have no ability to grant refunds — Apple holds the money and the customer relationship for purchases.
4.6 Right of withdrawal (EU / Austria)
For consumers in the EU, the EU Consumer Rights Directive provides a 14-day right of withdrawal for digital services. By starting your free trial or paid subscription, you expressly request that we begin delivery of the digital service immediately and you acknowledge that you lose your right of withdrawal as soon as the service starts (per Art. 16(m) Consumer Rights Directive, transposed into Austrian FAGG §18 Abs. 1 Z 11). This is standard for App Store subscriptions and identical to how every other in-app subscription works on iOS.
Cancellation through Apple as described in 4.4 is always available regardless.
5. Your data
How we handle your data is described in our Privacy Policy. In short: your sobriety data never leaves your iPhone. The only data that crosses the network is the subscription token exchange between Apple, our subscription provider RevenueCat, and your device — required to verify whether you have an active subscription.
6. Acceptable use
You agree not to:
- Reverse-engineer, decompile, or attempt to extract the source code of the App, except where Austrian law expressly permits this and we cannot contract around it (e.g., interoperability rights under §40e UrhG).
- Use the App to harass, harm, or endanger yourself or others, or to encourage others to do so.
- Misrepresent the App as your own product or remove our copyright notices.
- Use the App for any unlawful purpose.
7. Intellectual property
The App, the Website, all source code, design assets, text, icons, illustrations, and the "SoberBeing" name are owned by Sven Plochberger and protected by Austrian and international copyright, trademark, and other intellectual-property laws. The App is licensed to you, not sold. Open-source components used in the App are credited in the App's "Acknowledgments" screen and remain governed by their respective licenses.
8. Disclaimers
The App is provided "as is" and "as available." To the maximum extent permitted by Austrian law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or that it will achieve any particular outcome for your sobriety, recovery, or wellbeing. You are solely responsible for your own decisions, health, and wellbeing.
9. Limitation of liability
To the maximum extent permitted by Austrian law:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App or Website.
- Our total liability for any direct damages, whatever the cause, is limited to the total amount you paid us through Apple in the 12 months before the event giving rise to the claim, or €50, whichever is greater.
Nothing in these Terms limits our liability for: (a) gross negligence or intent (grobe Fahrlässigkeit oder Vorsatz) under Austrian law; (b) personal injury or death caused by our negligence; (c) any other liability that cannot be excluded or limited under Austrian mandatory law (especially KSchG consumer-protection provisions where you are a consumer).
10. Crisis and emergency situations
The App is not a crisis service. If you are in danger of harming yourself or others, contact emergency services immediately — in Austria, dial 112 for emergencies, 142 for Telefonseelsorge, or visit the helplines listed in the App's Profile screen.
11. Changes to the App and these Terms
We may update the App and these Terms from time to time. Material changes to the Terms will be announced through the App Store update release notes or by updating the "Last updated" date at the top of this page. Continued use of the App after a change constitutes acceptance of the new Terms.
If a change materially reduces your rights, we will give you at least 30 days' notice before it takes effect and you may cancel your subscription at any time before the change takes effect.
12. Termination
You may stop using the App at any time. We may suspend or terminate your access if you materially breach these Terms, with reasonable notice unless immediate action is required to protect others or comply with law.
13. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Austria, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods.
For consumers domiciled in the EU: this choice of law does not deprive you of the protection of any mandatory consumer-protection rules of the country where you have your habitual residence.
Place of jurisdiction is Wien, Austria for all disputes not subject to mandatory consumer-jurisdiction rules. Consumers may bring claims at their place of residence as provided by EU Regulation 1215/2012.
14. Online dispute resolution
The European Commission provides an online dispute-resolution platform at ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute-resolution procedures before a consumer arbitration board.
15. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force.
